Circular No. 17/2011/TT-BCT guides the implementation of the rules of origin provided in the Bilateral Trade Promotion Agreement between the Ministry of Industry and Trade of Vietnam and the Ministry of Trade of Cambodia applicable to goods originated from the signing country which are eligible for preferential import tariff treatment upon being directly imported into the teritory of the other country.
The Circular refers to Certificates of Origin (C/O) of Form X and Form S as stipulated at Appendices I and II, respectively. They both have light color. Each set of C/O includes an original and three copies.
For non-tariff commodities, these forms have one year of effect from the signing date. For tobacco and paddy rice, C/O of Form S issued in Cambodia enters into force since its signing date until December 31 of the year. It is regulated at Decision No. 013/2007/QD-BCT dated December 27, 2007 of the Trade Minister.
The two forms granted after the export of goods must be stamped as “Issued Retroactively”.
In addition to the regulations at this Circular, the determination of origin and implementation of related regulations need compliance with those at Circular No. 21/2010/TT-BCT dated May 17, 2010 of the Ministry of Industry and Trade implementing Rules of Origin at ASEAN Goods Trade Agreement.
The Circular becomes effective from June 1, 2011.
