This Decree stipulates the act of violation, the sanctioning form, the sanctioning level and remedial measures applicable to acts of administrative violation, the sanctioning competence and the competence to make records of administrative violations in Fertilizer field.

Other acts of administrative violation in the field of fertilizers are not provided for in this Decree, the provisions of other decrees of the Government on sanctioning of administrative violations in the field of State management shall apply authority to sanction.

This Decree takes effect from the date of its signing, except for Clause 4, Article 7 of this Decree, takes effect from September 20, 2020, for organizations and individuals that have been or are engaged in trading activities. Fertilizer before September 20, 2017.

This Decree abrogates Articles 19, 20, 21, 23, 24 and 25 of the Government's Decree No. 163/2013/ND-CP of November 12, 2013 on sanctioning of administrative violations in the field of chemicals and fertilizers and industrial explosives; Article 18 of Decree No. 115/2016/ND-CP of July 8, 2016, amending and supplementing a number of articles of the Government's Decree No. 163/2013/ND-CP November 12, 2013 of the Government regulating sanctions against administrative violations in the field of chemicals, fertilizers and industrial explosive materials.

For acts of administrative violation in the field of fertilizers made or discovered before the effective date of this Decree while being considered and settled, the sanction shall be imposed according to Decree No. 163/2013/ND-CP of December 12, November 2013 of the Government regulating sanctions against administrative violations in the field of chemicals, fertilizers and industrial explosives and Decree No. 115/2016/ND-CP dated July 8, 2016, A number of articles of Decree No. 163/2013/ND-CP of November 12, 2013, except for cases where the administrative violations of this Decree stipulate lighter liability, shall be sanctioned according to this Decree.
