Amending Decree 68/2016/NĐ-CP towards the direction of reform and simplification procedures

Summary

On 2/8, General Department of Vietnam Customs organized a conference for taking comments from local Customs and enterprises about a draft Decree for amending and supplementing Decree 68/2016/NĐ-CP, on business conditions for duty-free goods, warehouse, point of implementing customs procedure, gathering, inspection and supervision. According to the plan, the draft Decree will be presented to the Government in Quarter 3 of 2018.

At the conference, the Deputy Director General of Vietnam Customs, Mai Xuan Thanh, said that the draft Decree amending and supplementing Decree 68/2016/ND-CP was built in the context that the Government directed drastically to cut down business conditions; At the same time, the goal of developing logistics services is also accelerating.

Therefore, the revision of legal documents will be carefully considered by the drafting committee, based on the objective of enterprises facilitation, but also meeting the management requirements.

Moreover, the management of warehouses and yards must in line with the direction of modernization, does not restrict the operations of small vendors to happen, due to difficulty for control.

In order to meet that goal, Deputy Director General Mai Xuan Thanh suggested the participants to contribute opinions and comment on the draft Decree fully and specifically. The Customs authorities will listen and learn in order to complete the drafts before submitting to the Ministry of Finance for submission to the Government.

Accordingly, the amended content includes groups of issues such as: Amendment, supplement the explanation of words in the Article 3 of Decree 68/2016/ND-CP; To supplement and explain the terms of bonded warehouse and the places for gathering, inspection and supervising of goods sent via post or express services.

The content groups which amend regulations on recognition conditions includes: Supplement to locations of the bonded warehouses; To amend and supplement the location of the places for gathering, inspection and supervision of goods sent by post or express services; To supplement provisions on the area of bonded warehouses to serve for export processing enterprises; abolishing Clause 1 of Article 31 on space for implementing customs procedure sites at the ICD.

About the software system, amending all the articles 4, 10, 19, 22, 31, 36 which are about the condition of management software of goods receipt, goods issue or backlogs as well as warehouse management. Ensuring the connection with the Customs authorities in accordance with Article 41 of the Customs Law and Circular No. 39/2018/TT-BTC.
