Plan for settlement when the e-Customs system has not received documents of Customs dossier

Accordingly, for declarations classified into Yellow channel and Red channel, Customs officers shall receive paper documents of Customs dossiers submitted by declarants to carry out Customs procedures and Customs clearance as per regulations.

For the declarations classified into Green channel, Customs officers shall request a customs declarant to send additional documents in Customs dossiers via the Customs system after Customs clearance within 5 days since the date of Customs clearance.

In order to avoid overloading the system, the General Department of Vietnam Customs has requested provincial and municipal Customs Departments to notify and recommend Customs declarants to send additional documents of Green channel declaration via the system beyond the working hours or in days off and holidays.

Regarding this issue, in the past few days, complying with provisions in Circular 39/2018/TT-BTC, the General Department of Vietnam Customs has requested Customs declarants to submit documents in Customs dossiers via the system. However, as per reflection by enterprises and local customs departments, when e-documents are sent to the system, it receives these documents slowly or cannot receive.

Besides, some Customs Branches are implementing the guidelines on upgrading the functions of declaration check via the surveillance area in the e-Customs data processing system and only permit the confirmation of goods passing through the surveillance area when the e-documents are updated to the system.

This has led to the backlog of goods at ports, prolonging Customs clearance time. Therefore, when waiting for the upgrade of the system to meet the requirements of Circular 39/2018/TT-BTC, the General Department of Vietnam Customs has guided the implementation as mentioned above to remove shortcomings for enterprises in a timely fashion.
