The General Department of Vietnam Customs has instructed provincial and municipal Customs departments in applying Safeguard Tariff Policies under Decision 1931/QD-BCT and Decision 536/QD-BCT.
Specifically, the General Department of Vietnam Customs said that based on the proposal by the Ministry of Industry and Trade in Official Letter 7354/BCT-PVTM dated September 12 2018 on the application of the Safeguard Tariff Policies under Decision 1931/QD-BCT and Decision 536/QD-BCT.
Article 1 of Decision 1931 provides that “Officially applying Safeguard measures for Pre-painted Galvanized steel sheet products under HS codes 7210.7010, 7210.7090, 7212.4010, 7212.4020, 7212.4090, 7225.9990, 7226.9919, 7226.9999 imported into Vietnam from various countries/territories with detailed contents stated in the Notification enclosed with this Decision”.
Article 1 and Article 3 of Decision 536/QD-BTC amended and supplemented 08 HS codes of Decision 1931/QD-BCT into 13 new HS codes as follows: “7210.70.11; 7210.70.19; 7210.70.91; 7210.70.99; 7212.40.11; 7212.40.12; 7212.40.19; 7212.40.91; 7212.40.92; 7212.40.99; 7225.99.90; 7226.99.19; 7226.99.99” and took effect on 1st January 2018.
Therefore, based on the practical application of Safeguard measures and to ensure the effective enforcement of Safeguard measures, before 1st January 2018, all Pre-painted Galvanized steel sheet products under 8 HS codes stated in Decision 1931/QD-BCT dated May 31 2017 are subject to Safeguard measures application as per Decision 1931/QD-BCT.
From 1st January 2018, all Pre-painted Galvanized steel sheet products under 13 HS codes stated in Decision 536/QD-BCT dated February 9 2018 are subject to Safeguard measures application under Decision 1931/QD-BCT and Decision 536/QD-BCT. The description of the goods listed in Section 2 of the Notification attached to Decision 1931/QD-BCT is only a basis for the Customs authorities to refer further when carrying out the Customs procedures.
In addition, the General Department of Vietnam Customs said that, if the imported goods under the above HS codes are not subject to investigation and have not been manufactured domestically, enterprises may apply for exemption from safeguard measures in accordance with regulations Section 8 and Appendix 2 of the Notification attached to Decision 1931/QD-BCT.
