Circular No. 28/2015/TT-BCT provides for the pilot project on self-certification of goods origin within ASEAN area, applicable to traders from such countries as Vietnam, Laos, the Philippines, and Thailand.

The Circular applies to traders exporting or importing goods to or from member states of the memorandum according to ASEAN Trade in Goods Agreement and relevant agencies, organizations and individuals.

The Circular says every trader certified by the MOIT to join in the self-certification pilot project may apply for the certificate of origin of goods form D (C/O Form D) according to regulations in Circular No. 21/2010/TT-BCT and Circular No. 42/2014/TT-BCT.

The traders selected to implement the self-certification pilot project must be those who are producers and also exporters of goods they produce; who do not commit violations against regulations on goods origin over the last two years prior to the date of application; who obtain export turnover of at least USD10 million to ASEAN under C/O form D of the preceding year; whose employees are trained and granted with certificates of training in goods origin by a MOIT-appointed training institution.

Accordingly, the selected traders shall be issued the authorization valid for one year as from the issuing date by the MOIT’s Export and Import Administration.

The contents of origin declaration on commercial invoice (for replacing C/O Form D) shall comply with Article 7 of this Circular.

Goods imported from the countries participating in the pilot project shall be entitled to tariff incentives upon satisfying the conditions on which the commercial invoice has the contents of origin declaration issued by the exporter, and they are the products on the list sent by the MOIT.

This Circular comes into effect from October 5, 2015.
