Decree 41/2017/ND-CP additionally penalizes some violations in the field of fisheries, livestock and forest protection; in addition to changing the level of sanctioning administrative violations in the field of livestock, veterinary, fisheries and forest management.

1. Administrative sanctions in the field of fisheries

Decree 41/2017/NĐ-CP regulating the fine level for violations of regulations on the protection of aquatic species in Decree 103/2013/NĐ-CP is an administrative fine of from 1 million to 40 million (the current level is 300,000 dong) to 40 million).

Accordingly, the behavior of the fishing vessel owners to bring Vietnamese fishing vessels or fishermen illegally exploiting in the waters of other countries will be fined from 70 million to 100 million (current level is 50 million to 70 million ).

Decree 41/2017/ND-CP stipulates penalties for using electricity for fishing with a fine of from 3 million to 50 million.

Captains and crew members when fishing without diplomas will be fined from 1 million to 2 million.

2. Administrative sanctions in the field of veterinary medicine, animal feed and animal breeds

Under the provisions of Decree 41/2017/NĐ-CP, for violations committed by the following pet owners, a fine of between VND 2 million and 3 million shall be imposed:

- Do not vaccinate rabies dogs;

- Use of veterinary drugs not included in the List of veterinary drugs permitted for circulation;

- Throwing animal carcasses carrying germs into the environment.

Also in Decree 41 of 2017, acts of importing or transiting into Vietnam animals infected or infected with pathogens will be fined from 20 million to 30 million.

Acts of transporting, trading and slaughtering animals containing banned substances in livestock will be fined from 40 million to 50 million. (Old fine is 10 million to 15 million)

For violations of the use of antibiotics, banned substances in animal husbandry, aquaculture, production and trading of animal feed under the provisions of Decree 41 of the Government will be fined from 20 million to 100 millions.

3. Administrative sanctions in forest management, protection and development activities

Forest environmental service users who do not sign contracts to pay for forest environmental services after 3 months will be fined from 1 million to 50 million.

Also according to the Decree 41 of the Government in 2017, users of forest environment services who do not pay or pay incomplete services will be subject to administrative penalties ranging from 1 million to 50 million.

Decree 41/2017/ND-CP on changing the penalty for administrative violations in the field of veterinary medicine, animal husbandry and forest management and protection takes effect from May 20, 2017 and replaces Decree 40/2015/ND-CP.
