This is the outstanding content in Circular 143/2018/TT-BQP issued by the Ministry of Defense on September 15, 2018.
Accordingly, acts of violating the regulations on hanging the National Flag of Vietnam and flying the national flags stipulated in Article 7 of Decree 162/2013/ND-CP (amended and supplemented) are determined as follows:
- Hanging flags for vessels at seaports shall comply with the provisions of Clause 1, Article 61 of Decree 58/2017/ND-CP of May 10, 2017.
- Hanging National Flag on Vietnamese ships shall comply with the provisions of Clause 2, Article 61 of Decree 58/2017/ND-CP of May 10, 2017;
- Hanging the national flag and hanging the national flag of Vietnam for foreign vessels operating in the sea border areas shall comply with the provisions of Clause 2, Article 8 of Decree 71/2015/ND-CP of September 3, 2015.
Violation of the regulations on suspension of national flags and the posting of national flags will be:
- A fine of between VND 2,000,000 and VND 4,000,000 shall be imposed for acts of failing to fly the Vietnamese flag or to fly the national flag of Vietnam in contravention of regulations of Vietnamese vessels;
- A fine of between VND 5,000,000 and 10,000,000 for foreign vessels not flying the national flag or the national flag of Vietnam or hanging improperly when operating in Vietnam's internal waters.
Circular 143/2018/TT-BQP takes effect from November 1, 2018.
