I. Administrative violations, forms, levels of sanction and measures to overcome consequences in the field of plant varieties

- For violations of regulations on production of plant varieties, Decree No. 31 is fined from 20,000,000 VND to 30,000,000 VND for violations of production for commercial purposes of plant varieties not named in The list of plant varieties permitted for production and trading in Vietnam or not yet recognized by the Ministry of Agriculture and Rural Development is new.

- Regarding business of plant varieties, Decree 31/2016/ND-CP has provisions:

A fine of between VND 6,000,000 and under VND 10,000,000 when trading a plant variety lot valued at between VND 10,000,000 and under VND 20,000,000 for one of the following acts of violation:

+ Trading in expired plant varieties;

+ Trading in plant varieties not named in the list of plant varieties permitted for production and trading in Vietnam or those not yet recognized by the Ministry of Agriculture and Forestry as new agricultural and forestry plant varieties.

II. Administrative violations, forms, levels of sanction and measures to overcome consequences in the field of plant protection and quarantine
- For violations of regulations on plant quarantine for export, import and transit, Decree 31/2016/ND-CP stipulates:

A fine of between VND 20,000,000 and 30,000,000 for one of the following acts:

+ Bringing into Vietnamese territory objects subject to plant quarantine without taking handling measures under the provisions of the imported plant quarantine permits;

+ Bringing into Vietnamese territory objects of plant quarantine or objects subject to control or strange living pests without permission of the Minister of Agriculture and Rural Development;

- Regarding the use of plant protection drugs, Decree 31/2016/ND-CP stipulates:

+ A fine of between VND 2,000,000 and 3,000,000 for acts of violating the use of plant protection drugs not in accordance with the contents inscribed on the labels, causing dangerous consequences.

+ A fine of between VND 3,000,000 and 5,000,000 for acts of violating the use of plant protection drugs in the List of plant protection drugs banned from use in Vietnam.

- For violations of regulations on import of plant protection drugs, Decree 31/2016/ND fined from 30,000,000 VND to 40,000,000 VND for acts of importing banned plant protection drugs. in Viet Nam.

Decree 31/2016/ND-CP takes effect from June 25, 2016 and replaces Decree 114/2013/ND-CP.
