Circular 02/2016/TT-TTCP amending Circular 07/2013/TT-TTCP regulating the process of handling administrative complaints issued by the Government Inspectorate on October 20, 2016.
Accordingly, Circular 02/2016 amended and supplemented Circular 07/2013 in the following contents:
- If many people complain about the same content and appoint a representative to present the complaint content, only accept the complaint when there are sufficient signatures of the complainants and the document appointing representatives content of administrative complaints.
- Circular 02/2016/TT-TTCP additionally provides for extension of time to verify the content of administrative complaints if administrative complaint settlers or agencies, organizations, units and individuals are assigned internal verification Content of administrative complaint has not yet been verified.
- The person verifying the content of the administrative complaint shall send a written request to provide information, documents and evidence related to the content of the administrative complaint according to the form in Circular 02/2016/TT-TTCP.
The content of the work must be recorded in writing clearly stating the location, time, composition, content, information, documents, evidence delivered and received at the meeting and signed by the parties.
The minutes are made at least 02 copies and each party keeps 01 copy.
- According to Circular 02/2016/TT-TTCP, the complaint settler decides to solicit expertise when it is necessary to assess the content related to professional and technical issues as a basis for concluding the complaint content.
- Regarding cases of dialogue and Circular No. 02 in the second administrative complaint settlement process, the complaint settler must conduct a dialogue.
Regarding the participants and dialogue contents, Circular 02 of 2016 is amended as follows:
+ Removing the person responsible for verifying the content of the complaint from the participant in the dialogue;
+ If the complainant or legal representative has been notified in writing for the second time, the complaint settler shall make a written record to terminate the dialogue.
In addition, Circular No. 02 of the Government Inspectorate also added some forms for complaints; extend the verification time and decide to solicit expertise.
Circular 02/2016/TT-TTCP takes effect on December 5, 2016.
