The Ministry of Health amended the ingredients of cosmetic product announcement file
On December 16, 2019, the Ministry of Health issued Circular 32/2019 / TT-BYT on amending and supplementing Clause 4 Article 4 and Appendix No. 01-MP Circular 06/2011 / TT-BYT regulating regulations on cosmetic management.
Accordingly, the composition of the cosmetic product proclamation dossier for the certificate of free sale (CFS) is amended in the following specific cases:
Firstly, in case of announcing cosmetic products imported from countries that are not CPTPP members, CFS must meet the following requirements: CFS issued by cosmetic exporting country to Vietnam is original, still valid. . In case the CFS does not specify the time limit, it must be a copy issued within 24 months from the date of issue.
In addition, the CFS must be consular legalized in accordance with the law, except for the case of consular legalization exemption under international treaties to which Vietnam is a member. CFS must have at least the information as prescribed in Article 36 of the Law on Foreign Trade Management and Clause 3 Article 10 of Decree 69/2018 / ND-CP.
Second, the case of cosmetic product publication being circulated and exported from CPTPP member countries (CPTPP Member State is any particular State or customs territory to which the CPTPP Agreement has been approved and has. validity) is not CFS required.
This Circular takes effect from February 1, 2020.
This Circular amends and supplements Circular 06/2011 / TT-BYT.
