Exempting AHK form C / O for goods valued at less than US $ 200 FOB

On November 8, 2019, the Ministry of Industry and Trade issued Circular 21/2019 / TT-BCT regulating the Rules of Origin of Goods in the ASEAN - Hong Kong Free Trade Agreement, China.

Specifically, in the case of goods originating from an exporting Member State whose value of FOB does not exceed US $ 200 is exempted from submitting the C / O form AHK and only needs a simple declaration from the exporter that the goods it has the origin of the exporting Member State. Goods sent by post with FOB value not exceeding US $ 200 also apply this provision.

Besides, it is not allowed to erase or write on the C / O form AHK. Any amendment must be made in either of the following ways:

Firstly, cross out the wrong place and add the necessary information. These changes must be approved by the person competent to sign the C / O form of AHK and certified by the agency / organization issuing the C / O. The remaining space must be crossed out to avoid additional filling.

Secondly, issue new AHK C / O to replace the old C / O. Accordingly, C / O of AHK form shall be issued by C / O agency of the exporting Member before or at the time of delivery but not later than 03 working days after the date of delivery. If the AHK form C / O is issued due to unintentional errors or other plausible reasons, the AHK form C / O may be issued later but not later than 01 year from the date of delivery and must be marked in the box. number 13 where the words "ISSUED RETROACTIVELY".

This Circular takes effect from December 23, 2019.
