Article 1. To amend and supplement Clause 3, Articles 3 and Clause 3, Article 9 of the Ministry of Industry and Trade’s Circular No. 06/2011/TT- BCT of March 21, 2011
1. To amend Clause 3, Article 3 on applicants for preferential certificates of origin (C/O) as follows:
“3. Applicants for preferential C/O (below referred to as C/O applicants) are Vietnamese traders, including exporters, producers and lawful representatives of exporters or producers.”
2. To add the following Clause 9 to Article 9 on C/O application dossiers:
“9. For exports kept in bonded warehouses, in addition to the vouchers and documents specified in Claus e 1 thru Clause 8 of
Article 9, the C/O applicant must submit the following vouchers and documents:
a/ Declaration of goods brought into and out of the bonded warehouses,
with the customs office’s certification of goods arriving the border gate of exportation and the ex-warehousing bill: 1 (one) copy with the trader’s true copy mark;
b/ Contract or agreement signed between the Vietnamese trader and the foreign customer consigning goods at the bonded warehouse, which provides that the Vietnamese trader delivers goods to the importer in a country having the Free Trade Agreement with Vietnam: 1 (one) certified copy with the trader’s true copy mark; or
c/ Contract or agreement signed by the foreign customer consigning goods at the bonded warehouses and the importer in a country having the Free Trade Agreement with Vietnam, which provides that the Vietnamese trader delivers goods to the importer: 01 (one) certified copy with the trader’s true copy mark
