Amending and supplementing Circular 03/2019 / TT-BCT on rules of origin of goods
On March 24, 2020, the Ministry of Industry and Trade issued Circular 06/2020 / TT-BCT amending and supplementing a number of articles of the Minister's Circular 03/2019 / TT-BCT dated January 22, 2019. The Ministry of Industry and Trade defines the rules of origin in the Comprehensive and Progressive Agreement for Trans-Pacific Partnership.
Accordingly, the Ministry of Industry and Trade supplements the provisions on De Minimis of textiles and garments in Article 29 of Circular 03/2019 / TT-BCT. Specifically, the Ministry explains the concept of "wholly formed" in Clause 3: the entire production and finishing process, starting from extruding filaments, strips, films or sheets, and bags. including stretching the filament or cutting the film or sheet to strip, or spinning the fibers into yarn, or both, and finally a finished yarn or plied yarn is obtained.
In addition, the Ministry of Industry and Trade also replaces 04 appendices in Circular 03/2019 / TT-BCT with the appendices issued together with this Circular. Specifically, the replaced appendices include: Appendix III - Exceptions applying De Minimis, Appendix IV - Form C / O CPTPP of Vietnam, Appendix V - Form of C / O supplementary declaration CPTPP form of Vietnam, Appendix VI - Guidance on C / O declaration of CPTPP form and additional declaration.
The Circular takes effect from May 8, 2020.
