No revocation of the certificate of duty-free goods if the notification is resumed

On June 15, 2020, the Government issued Decree 67/2020 / ND-CP amending and supplementing a number of articles of Decree 68/2016 / ND-CP dated July 1, 2016 of the Government regulating regulations on conditions for trading in duty-free goods, warehouses, and locations for customs clearance, customs gathering, inspection and supervision.

Accordingly, amending regulations on the revocation of the certificate of eligibility for trading in duty-free goods after the suspension period is over. Specifically, the enterprise is revoked the certificate of eligibility for trading in duty-free goods if it suspends operation for more than 6 months from the date of notification without a written notice of re-operation. According to old regulations, this Certificate is revoked in all cases of business suspension for more than 6 months.

In addition, the provisions on the conditions for granting certificates of eligibility for duty-free business were also amended and supplemented. Specifically, the store's camera system must be connected online with the managing customs authority, images can be viewed at all positions 24/24 hours and store data on images for at least 06 months (time save image data for the minimum under the old rule of 12 months).

Similarly, the minimum camera image data retention time for bonded warehouses has been reduced from 12 months to 6 months. On the other hand, the documents for recognition of bonded warehouses are also reduced by 3 types of documents compared to the old regulations: documents describing the bonded warehouse management software program, papers proving the right to use bonded warehouses. and Operation Regulations.

The Decree takes effect from August 10, 2020.

This Decree partially expires Decree 68/2016 / ND-CP on conditions for trading in duty-free goods, warehouses, and places for customs clearance, customs gathering, inspection and supervision. and Decree 59/2018 / ND-CP.
