Guidance on the implementation of temporary custody mechanism under the Istanbul Convention

On June 10, 2020, the Government issued Decree 64/2020 / ND-CP guiding the implementation of the temporary detention mechanism under the Istanbul Convention.

Specifically, the temporary custody book (ATA book) is a document to carry out temporary custody of goods, is accepted to replace the customs declaration for customs clearance and ensure payment of import duties and other taxes. , late payment interest, fines and fees and charges (if any) for temporarily controlled goods. ATA book has a expiry date of 12 months from the date of issue.

In addition, the agency that issues the ATA book in Vietnam is the Vietnam Chamber of Commerce and Industry (VCCI). An application for ATA book includes:

Firstly, 01 original copy of the signature sample registration of the authorized person signing the ATA application form and the enterprise's seal sample (in case the organization requests the ATA book).

Second, 01 original copy of the Application for issuance of ATA book.

Third, 01 original letter of guarantee issued by a credit institution, foreign bank branch or money order to VCCI ...

In addition, the Government also provides a guarantee for the issuance of ATA books determined by VCCI at 110% of the total import tax amount and other highest taxes of the country where temporarily controlled goods go through. If the security amount is insufficient to pay import tax, other taxes, late payment interest, fines and fees (if any) of the temporarily controlled goods, the ATA book holder is obliged to pay additional outstanding balance for VCCI.

This Decree takes effect from July 30, 2020.
