Decree No. 137/2013/ND-CP dated 21 October 2013 of the Government detailing the implementation of some articles of the Law on Electricity and the Law amending and supplementing a number of articles of the Law on Electricity

Circular No. 124/2008/TT-BTC of the Ministry of Finance, providing for the rates and the collection, remittance, management and use of the charge for evaluation, and the fees for licensing in the electricity industry

Circular No. 10/2015/TT-BCT of the Ministry of Industry and Trade, providing for order and procedures for issue, revocation and duration of permits in the electricity industry.

Written request for permit on electricity operation made according to the Form 01 specified in the Annex enclosed with Circular No. 10/2015/TT-BCT.

Copy of certificate of enterprise registration

Copy of Decision approving the policy on electricity sale with foreign countries, approved power grid connection plan for electricity sale with foreign countries

4

Copy of electricity import and export contract or copy of written request for electricity purchase or electricity sale approval from foreign country.

Diagram of power grid principles concerning the electricity sale points and procedures for coordinated operation and processing of power grid events between the electricity buyer and the seller (if any).

Certified copy of document of prescribed implementation of regulations on fire prevention and fighting at the substations.

In case of change of name, address of head office of the unit issued with the permit, the dossier includes only the following materials: Written request for permit on electricity operation, copy of certificate of enterprise registration, decision on establishment or Certificate of establishment of the enterprise applying for permission

 

Process Steps

Step 1

For dossiers sent directly or by post: 
The enterprise applying for permission on electricity operation shall submit 01 set of dossier as prescribed to the Electricity Regulatory Authority 
The Electricity Regulatory Authority shall receive, examine the dossier and issue a written notice on the accuracy and validity of the dossier within 03 working days from the reception of dossier. The written notice shall state relevant reasons and request for supplementation or completion of dossier. Within 05 working days after the reception of written notice, the applying enterprise shall supplement or modify the dossier documents and reply in writing. 
If within 60 days from the date the licensing authority sends its written notice of supplementation and modification but the applying enterprise does not supplement the dossier and reply in writing, the licensing authority has the right to return the dossier. 
Within 15 working days after the reception of complete and valid dossier, the licensing authority shall verify such dossier, inspect at the head office of the applying enterprise (if necessary) and issue the Permit on electricity operation.
