Legal basis of the Procedure                
  • Decree No. 187/2013/ND-CP dated November 20, 2013 of the Government, detailing the Commercial Law regarding international goods purchase and sale and goods purchase and sale agency, processing and transit activities with foreign partners;
  • Decree No. 67/2013/ND-CP elaborating some articles and measures for implementation the law on tobacco harm prevention applicable to tobacco trading
  • Circular No. 37/2013/TT-BCT Providing the import of cigarettes and cigars
Processing time
  • Within 5 (five) working days after receiving the complete and valid dossier, the Ministry of Industry and Trade’s Import-Export Department shall certify the trader’s written registration for automatic import of cigarettes and cigars. In case the dossier is neither complete nor valid or if refusing to certify the written registration, the Import-Export Administration Department shall issue a reply to require the trader to supplement the dossier or notify the trader of relevant reasons.

Process Steps
Step 1
Trader shall send 1 (one) set of dossier of applying for permit, via post, to the Export and Import Department - the Ministry of Industry and Trade.
Step 2
The Ministry of Industry and Trade shall check the validity and completion of the dossier. Within five (05) working days after receiving a complete and valid dossier, the Ministry of Industry and Trade shall grant the Permit of automatic import.
Step 3
If the dossier is not complete or valid, or in case of refusing to grant the permit, the Ministry of Industry and Trade shall notify in writing or via postal service of contents to be fixed or added to complete the dossier or state relevant reasons for refusal.
Step 4
The written certification for granting the permit shall be sent to the trader via postal system.
Step 5
Reporting regime:
Within the first 15 (fifteen) days of the coming quarter, the trader importing cigarettes and cigars shall submit to the Ministry of Industry and Trade’s Import-Export Department a report on the import of cigarettes and cigars in the previous quarter, clearly specifying: categories, quantity, value of imported goods, selling price and projected import plan in the future (made according to the form provided in Appendix III of Circular No. 37/2013/TT-BCT)
Annually, before October 15, the trader importing cigarettes and cigars shall submit to the Ministry of Industry and Trade’s Import-Export Department a report on the import of cigarettes and cigars in 3 (three) quarters (in replacement of the report for the 3rd quarter) and the import plan for the subsequent year.
