Legal basis of the Procedure
|
- Decree 114/2014/NĐ-CP stipulates objects and conditions for import and / or demolition of used sea-going vessels.
- Circular 37/2015/TT-BGTVT regulates the procedures for issuance of licenses for import of used sea-going vessels for dismantlement issued by the Ministry of Communications and Transport.

Process Steps
|
Step 1
|
In case of direct submission, the Vietnam Maritime Adminitration Department shall receive and examine the dossiers, if the dossiers are complete as prescribed, they shall issue dossier receipts and make appointment for results according to regulations; If the dossiers are incomplete, the enterprises shall have to complete the dossiers according to regulations

Step 2
|
In case of receipt of dossiers through the postal system or other appropriate forms, if the dossiers are incomplete according to regulations, within 2 (two) working days after receiving the dossiers, the Vietnam Maritime Administration department must have documents to guide enterprises to complete the dossier;

Step 3
|
Within ten (10) working days from the date of receipt of complete dossiers as prescribed, Vietnam Maritime Administration department, evaluation and reporting to the Ministry of Transport for consideration and decision
|

Step 4
|
Within three (3) working days as from the date of receipt of the evaluation documents from the Vietnam Maritime Administration department, the Ministry of Transport shall consider the granting of permits for import of used sea-going vessels for dismantlement according to set form. 02 of the Appendix to this Circular; In case of refusal to grant a license for import of used sea-going ships for dismantlement, they must send written notices thereon to the enterprises and Vietnam Maritime Admininstration department, clearly stating the reasons
