Legal basis of the Procedure                   
  • Customs Law No. 54/2014/QH13 dated June 23, 2014.
  • Decree No. 08/2015/ND-CP of the Government dated January 21, 2015 providing specific provisions and guidance on enforcement of the Customs Law regarding customs procedures, examination, supervision and control procedures.
Processing time
  • Within 05 working days after receiving the complete and valid dossier The provincial/city Customs Department shall submit a proposal to the General Department of Customs
  • Within 07 days after receiving the dossier enclosing the report made by the local Customs Department, the General Department of Customs shall issue a written decision of reply

Enterprise who is given priority to establish the duty-suspension warehouse;

Enterprises who gain the export turnover of USD 40 million or more shall be eligible for establishment of the duty-suspension warehouse according to provisions of clause 1 and clause 1 Article 92 Decree No. 08/2015/ND-CP
Process Steps
Step 1
Submit the dossier
The enterprise specialized in production of commodities for export wishing to establish the duty-suspension warehouse shall submit the dossier to the Customs Department where the manufacturing facility is located
Step 2
Receive, verify and submit the dossier to the General Department of Customs
The  provincial/city Customs Department shall check the submitted documentation; survey or carry out the field inspection of the area where the facility will be built; assess conformity to requirements for establishment of the facility, and send a report and request to the General Department of Customs.
Step 3
Approval for establishment.
The Director of the General Department of Customs shall issue an approval for establishment of the duty-suspension warehouse if the prescribed requirements are met.
