Circular No. 41/2014/TT-BNNPTNT guides the implementation of several articles of the Government’s Decree No. 202/2013/ND-CP dated November 27, 2013 on fertilize management subject to the state responsibility of the MARD.
Particularly, the Circular details contents under the state management responsibility of the MARD, including:
- The production, trading, import, export, quality control, and testing of organic fertilizer and other fertilizers.
- The sampling of inorganic fertilizer, organic fertilizer, other fertilizers, fertilizer experiment, production limit and fertilizer import for fertilizer testing and utilization.
The Circular applies to organizations or individuals operating in areas related to production, trading, import, export, quality control, and testing of organic fertilizer and other fertilizers; and organizations or individuals having activities related to sampling, experiment, and utilization of fertilizer in Vietnam.
Promulgated together with this Circular are annexes on:
- Form of application for issuing license for production of organic fertilizer and other fertilizers;
- Form of license of organic fertilizer and other fertilizer production;
- Way to write the code of license for organic and other fertilizers;
- Form of report on result of examination, inspection and handling of violations of organic fertilizer and other fertilizers;
- Form of report on result of production and import of organic fertilizer and other fertilizers;
- Instructions on conditions for production of organic fertilizer and other fertilizers;
- Regulating main quality indicator and limiting factors in organic fertilizer and other fertilizers;
- Fertilizer experiment norm;
- Acceptable tolerance between analysis result compared with the published application.
This Circular takes effect from December 29, 2014 and annuls Circular No. 36/2010/TT-BNNPTNT dated June 24, 2010 of the Minister of MARD on issuing the regulation on production, trading, and utilization of fertilizers; Circular No. 52/2010/TT-BNNPTNT dated September 9, 2010 of the MARD concerning the instructions on experiment, accreditation, and naming of new fertilizers.

| Publication of conformity of organic fertilizer and other fertilizers | Before introducing the organic fertilizer and other fertilizers into the market, the organizations or individuals producing or importing fertilizers must publicize the conformity of the following fertilizers: a) Fertilizers named in the List of fertilizers which are produced, traded or used with permission in Vietnam which the Minister of Agriculture and Rural Development issued from 09 August 2008 to 27 November 2013. The organizations or individuals shall make publication of conformity as stipulated in Clause 2, Article 22 of Decree 202/2013/ND-CP; b) Fertilizer of producing and trading organizations or individuals or as a result of research project at State or Ministry level meeting the requirements for fertilizer experiment norm.
