Decree No. 77/2016/ND-CP provides for the supplements and amendments to following legislation:
- Decree No. 187/2013/ND-CP dated November 20, 2013 elaborating the implementation of the Commercial Law. The amended content relates to conditions for import/export of minerals, as well as conditions for temporary import for re-export of goods. It also contains the conditions for issuance of permit for production/ export processing of military uniforms of foreign armed forces.
- Decree No. 108/2008/ND-CP dated October 7, 2008 detailing and guiding the implementation of certain articles of the Law on Chemicals. The amended content relates to conditions for production/trading of industrial precursors
- Decree No. 38/2014/ND-CP dated May 6, 2014 on management of chemicals governed by the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction. The amended content relates to conditions for production of Schedule 1 chemicals
- Decree No. 76/2014/ND-CP dated July 29, 2014 detailing certain articles of the Ordinance on amendments to the Ordinance on management and use of weapons, explosive materials and combat gears. The amended content relates to conditions (technical facilities and chemical safety requirements) regarding trading of explosive precursors.
- Decree No. 39/2009/ND-CP dated April 23, 2009 providing for industrial explosives. The amended content relates to conditions for production, import/export and use of industrial explosives.
- Decree No. 202/2013/ND-CP dated November 27, 2013 providing for management of fertilizer. The amended content relates to conditions for production and sale of fertilizer and carrying out fertilizer experiments
- Decree No. 19/2016/ND-CP dated March 22, 2016 providing for gas business. The amended content relates to conditions for carrying out LPG bottle testing, production/ repair of LPG bottles
This Decree also stipulates:
- The provisions on ensuring food safety provided for food production and trading establishments and foods testing establishments
- The provisions on ensuring foods safety provided for processed milk, beer, vegetable oil production establishments
According to this Decree, the following goods items shall be temporarily imported for re-export under certain conditions: used goods; frozen foods; goods subject to excise duty
One of the most important conditions for carrying out the temporary import for re-export of the above – mentioned goods items is that an enterprise must have at least VND 7 billion (with regard to used goods; goods subject to excise duty) and at least VND 10 billion (with regard to frozen foods) deposited at a credit institution in the province or city where the enterprise’s warehouse is located
This Decree becomes effective since July 1, 2016 and annuls Clause 4 Article 15 of Decree No. 38/2014/ND-CP and point dd Clause 2, Clause 4 Article 8, Clause 7 Article 15 of Decree No. 202/2013/ND-CP.
