Decree No. 87/2016/ND-CP stipulates conditions for the manufacture, import and distribution of motorcycle helmets. It details procedures for obtaining the Certificate of eligibility to manufacture helmets; revocation of the Certificate; and import and distribution of motorcycle helmets.

According to the Decree, only enterprises are allowed to manufacture and/or import motorcycle helmets.

For helmet manufacturers, a part from eligibility conditions on legal status, quality control system, personnel, infrastructure and equipment (Article 5), they shall also possess the Certificate of eligibility to manufacture motorcycle helmets granted by the Ministry of Industry and Trade (Article 5) following procedures detailed in the Decree (Articles 6, 7 and 8). The Certificate may be revoked under specific cases.

Regarding helmet importers, they shall conduct quality management measures before customs clearance is granted in accordance with National Technical Regulations on imported motorcycle helmets (Article 10).

With regard to helmet distribution, there are also requirements on lawful establishment/ registration of distributors. The helmet agent or retailer shall have a fix address and noticeable signboard in front of their shops.

This Decree becomes effective since July 1, 2016.
