Decree No. 91/2016/ND-CP provides for the production and packaging, testing, experiment, sale registration, trading, transportation and export/import of insecticidal and germicidal chemicals and preparations for household and medical use.

It details requirements for manufacturers of preparations and establishments conducting testing and experiment of preparations (including those on personnel, facilities and equipments), as well as for sale of preparations. Accordingly, the manufacturers, testing establishments and preparations-used insecticidal and germicidal service providers must carry out procedures for declaration of eligibility for operation, in either direct declaration or online declaration.

For preparations registered for sale, they must meet the conditions specified in Article 19 of this Decree. Accordingly, the toxicity of preparations of which the registration is carried out is not classified in Class Ia or Ib according to the WHO’s classification system or in Heading I or II according to the Globally Harmonized System of Classification and Labeling of Chemicals (GHS).

With regard to rules of export/import of insecticidal and germicidal preparations, the preparations with valid sale registration certificates may be imported on demand in unlimited quantity or value and the import procedures shall be carried out at customs agencies without requiring the Ministry of Health's approval (Article 48). However, if they are imported for these purposes, the import license is required: research, aid, gifts (Article 49)

This Decree become effective since July 1, 2016 and annuls the following legislation:

- Clause 12 Article 12 of Decree No. 89/2006/ND-CP dated August 30, 2006 on labeling of chemicals;

- Clauses 2 and 3 Article 8 of the Government’s Decree No. 108/2008/ND-CP, amended at Clause 8 Article 1 of the Government’s Decree No. 26/2011/ND-CP dated April 8, 2011 detailing and guiding the implementation of certain articles of the Law on chemicals; and

- Clause 3 Article 18 of the Government’s Decree No. 104/2009/ND-CP dated November 9, 2009 promulgating the list of dangerous goods and transportation of dangerous goods by motor vehicles.
