Decree No. 45/2009/ND-CP dated May 13, 2009 of the Government guiding the import of samples, sampling, management and use of samples of drugs, precursors, addictive drugs and psychotropic medicines for purposes of national defense and public security
Decree No. 45/2009/ND-CP provides guidance for the import of samples, sampling, management and use of samples of drugs, precursors, addictive drugs and psychotropic medicines for skill training and tracking for drug crime prevention of defense and public security forces.
The Decree clarifies principles of taking lawful actions of drugs for purposes of national defense and security. Correspondingly, the import of samples, sampling, management and use of samples of drugs, precursors, addictive drugs and psychotropic medicines must be legitimate and conformable to this Decree’s regulations and other legal documents concerned.
Particularly, the application of this Decree’s regulations to breach rights and interests of individuals, agencies, and organizations, as well as state management rules of drug prevention is seriously prohibited.
In case law executors detect and seize at least 350 gr or 100 pills, tubes or 5 liters of drug, precursors, addictive drug and psychotropic medicines; or even smaller quantity of drug substances of new type, their sample must be legally verified and sent to the Criminal Science Institute under the Ministry of Public Security for tracing back to their origin.
This Decree becomes effective from July 1, 2009.
