Legal basis of the Procedure
  • Customs Law No. 54/2014/QH13 dated June 23, 2014.
  • Decree No. 08/2015/ND-CP of the Government dated January 21, 2015 providing specific provisions and guidance on enforcement of the Customs Law regarding customs procedures, examination, supervision and control procedures.
  • Decree No. 73-CP dated July, 30, 1994 of the Government on detailed regulations on the implementation of the Ordinance on the privileges and immunities of diplomatic representations, foreign consulates, and representative offices of international organizations in Vietnam.
  • Decision No. 53/2013/QD-TTg dated September 13, 2013, on temporary import, re-export, destruction and transfer of automobiles and motorbikes of entities eligible for privileges and immunities in Vietnam
  • Circular No. 19/2014/TT-BTC dated February 11, 2014 of the Ministry of Finance prescribing procedures for temporary import, re-export, destruction and transfer of automobiles and motorbikes of subjects entitled to privileges and immunities in Vietnam.
  • Decision No. 601/QD-BTC dated March 26, 2014 of the Ministry of Finance on correcting a number of Articles of the Circular No. 19/2014/TT-BTC dated February 11, 2014.

A written certification by a competent state agency that the automobile or motorbike can no longer be used due to an accident, a disaster or a technical breakdown

Process Steps
Step 1
Submit the customs dossier
The subject entitled to immunities and privileges in Vietnam shall prepare a set of dossier and submit it to the Customs Authority
Step 2
Receive and examine the dossier
The customs authority shall receive and examine the dossier
Step 3
Perform the re-export procedures
Perform the procedures for re-export of the vehicle (certification of the vehicle's details and specifications in the declaration).
Step 4
Complete the re-export procedures
Upon completion of re-export procedures, the border-gate Customs Sub-department carrying out re-export procedures for automobiles and motorbikes shall notify such in writing and make and send copies of the vehicle re-export declaration for which customs procedures have been completed to the provincial/city Customs Department that has granted the vehicle temporary import permit for liquidation of such permit under regulations.
