From 1st July 2017, petroleum warehouses will connect with the Customs

VCN- The General Department of Vietnam Customs has requested the provincial / municipal Customs Departments to guide enterprises in preparing conditions for online connection of petroleum data with the Customs officers according to the provisions of the Government's Decree No. 68 / 2016 / ND-CP on conditions for trading in duty-free goods, warehouses and yards, places of Customs procedures, Customs gathering, inspections and supervision.

Accordingly, from July 1, 2017, the provincial and municipal Customs department shall coordinate with enterprises to directly connect the petroleum warehouses and manage petroleum storage with access to the import-export management software and address of the surveillance image storage system.

The provincial/municipal Customs departments shall have to use and keep confidential information updated by enterprises as soon as they have accurate information on the volume of goods left at the end of the working day.

Regarding the surveillance image storage system, it must meet the technical and professional requirements prescribed in Decision No. 953 / QD-TCHQ on professional and technical requirements for surveillance camera systems in border-gate zones and outside the border gate of Customs operation. Accordingly, the surveillance image storage system (fixed and rotary scan) is the panorama of warehouse area, which can clearly observe the image of the means of import and export, the number of means of transport; and supervise all activities of the goods put into stock.

In order to verify the petroleum warehouses eligible for inspections and supervision by the Customs office, the provincial / municipal Customs Departments shall review and request enterprises to base themselves on Article 23 of Decree No. 68/2016 / ND-CP and the guidance of the General Department of Vietnam Customs for submission of dossiers for certification of eligible petrol and supervision.

For businesses only leasing gasoline storage, they have to ensure compliance with the provisions of Decree 68/2016 / ND-CP. Accordingly, the storage of gasoline must be inspected and supervised by the Customs office and must be specified in the warehouse lease contract.

Articles 22 and 23 of the Government's Decree No. 68/2016 / ND-CP stipulate:

"Article 22.- Confirmation of petrol and oil depots eligible for inspections and supervision by the Customs offices:

3. Software meets the following criteria:

a / Managing and monitoring petrol and oil entering, exiting, storing and remaining in stock.

b) Directly connecting the petrol data to the warehouses and put it in the warehouses with the Customs office managing the petroleum depot.

4. There is a need for a camera system that meets the following criteria:

a) Observe locations in petroleum depots. Observed images at all times of the day (24/24 hours).

b) The image data is kept for a minimum of 12 months.

c) The camera system is directly connected to the Customs administration.

The Director General of Vietnam Customs shall promulgate the standards for exchange of data between the Customs offices and petrol and oil traders on petrol and oil management software.

Article 23.- Dossiers of certification of satisfaction of inspections and supervision conditions by the Customs offices

1. A written request for certification of satisfaction of inspections and supervision conditions by the Customs office: 1 original.

2. The design diagram of the warehouse area, clearly showing the boundary line separated from the outside, the location of depots, tanks and cisterns: 1 copy.

3. Documents describing petroleum warehouse management software program: 1 original.

4. Documents proving the right to use petroleum depots: 1 copy.

5. The certificate of satisfaction of fire prevention and fighting conditions granted by the Police office: 1 copy. 6. Operational regulations: 1 original.”
