Based on Clause 7, Article 7 of the Biodiversity Law stipulating prohibited acts of biological diversity, it includes the act of "importing and developing invasive exotic species".

According to Circular No. 35/2018/TT-BTNMT of the Ministry of Natural Resources and Environment, crawfish are on the list of invasive exotic species; based on Appendix VIII issued with Decree 26/2019/ND-CP of the Government, crawfish is not included in the list of aquatic species permitted for trading in Vietnam.

However, the General Department of Customs requests the Ministry of Agriculture and Rural Development and the Ministry of Natural Resources and Environment to clarify the issue: Does the list of invasive exotic species which crawfish (Cherax quadricarinatus) is on, only apply to live crawfish, or include frozen or processed crawfish?

In the context that functional sectors are instructing to strengthen inspection, control and handling of crawfish, protect the environment and avoid negative impacts on agricultural production, the answers of the ministries and agencies concerned are important for the Customs authorities to strictly manage the import of crawfish into Vietnam.
